Waiver and Release of Liability

By participating in any activities at this property, you automatically agree to the following Waiver & Release.

In consideration of my involvement in activities at the property located at 313 Clancy Road, Braintree, VT 05060, including but not limited to treehouse use, zipline activities, climbing, and related recreational activities, I acknowledge, understand, and agree that:

1. Risk of Injury

I risk bodily injury, including but not limited to paralysis, dismemberment, disability, and death. These risks exist along with the risk of damage to or loss of property.

2. Assumption of Risk

I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others.

3. Participant Conduct

I agree to comply with all stated and customary rules for participation. If I observe any unusual or unnecessary hazard during my presence or participation, I will immediately bring it to the attention of the nearest site manager, owner, or representative.

4. Release of Liability

I, for myself and on behalf of my heirs, assigns, personal representatives, and successors, hereby release, hold harmless, and promise not to sue the property owners, hosts, volunteers, staff, sponsors, and/or agents with respect to any and all injury and/or loss arising from my participation, whether caused by the negligence of the releasees or otherwise, except in cases of gross negligence or willful misconduct, to the fullest extent permitted by Vermont law.

5. Food and Allergens

Food, including dinner and breakfast, may be offered on a donation-only basis. Such food is not prepared in a licensed facility and may contain allergens or substances that could cause reactions. I voluntarily assume all risks associated with consuming such food.

6. Non-Commercial Food Service

Meals and refreshments, when offered, are shared informally among guests and hosts and do not constitute a commercial restaurant, café, or catering service.

7. Governing Law

This agreement shall be governed by and interpreted according to the laws of the State of Vermont. Any disputes shall be resolved exclusively in Vermont courts.

8. Severability

If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment

By participating in any activity at the property, including but not limited to entering the grounds, staying overnight, or using any equipment or recreational features, you acknowledge that you have read and understood this Waiver & Release, and you voluntarily agree to its terms without the need for any physical or electronic signature.

If minors are present, the adult supervising them confirms that they have full legal responsibility for the minors and agree to this Waiver & Release on their behalf. The supervising adult also accepts full responsibility for ensuring minors follow all safety guidance and rules.
