The zipline may only be used with the express permission and under the direct supervision and accompaniment of the host.
Any unauthorized use of the zipline, including without limitation self-attachment or operation without host supervision, is strictly prohibited.
The host shall not be liable for any accidents, injuries, damages, or losses arising from or related to unauthorized or unsupervised use of the zipline, and guests assume all risks associated with such.
Guests are permitted to forage for wild mushrooms on the property at their own discretion, but the host does not provide guidance, identification, or endorsement of any such activities.
Any consumption of wild mushrooms foraged by guests is strictly at the guests’ own risk, including but not limited to risks of misidentification, poisoning, allergic reactions, illness, or death. Guests acknowledge that wild mushrooms can be highly toxic and that expert mycological knowledge is required for safe identification and consumption.
To the fullest extent permitted by law, the Released Parties shall not be liable or responsible in any way for any claims, demands, actions, damages, losses, or expenses (including legal fees) arising out of or related to foraging or consumption of wild mushrooms, whether due to negligence, misidentification, or otherwise. By booking and agreeing to these Terms and Conditions, guests expressly assume all such risks, waive any right to sue or seek compensation from the Released Parties for such incidents, and agree to indemnify and hold harmless the Released Parties from any third-party claims related thereto.
The grill, which operates on both propane and charcoal, may be used by guests following a demonstration provided by the host on safe operation. The host’s demonstration does not constitute ongoing supervision or guarantee of safe use.
Any use of the grill is strictly at the guests’ own risk, including but not limited to risks of burns, fires, explosions, injuries, property damage, or other accidents arising from cooking, propane handling, charcoal preparation, or related activities. Guests acknowledge that improper use can result in severe harm and that expert knowledge of grill safety is required.
Guests are obligated to use the grill carefully and responsibly, including but not limited to: ensuring the grill is placed at a safe distance from structures, flammables, and people (at least 10 feet from any building); closing all propane valves and connections tightly after each use; extinguishing coals completely and disposing of ashes safely; monitoring the grill at all times while in use; and confirming no fire risks before, during, and after operation. Failure to comply constitutes a material breach of these Terms and Conditions.

By booking and agreeing to these Terms and Conditions, guests expressly assume all such risks, waive any right to sue or seek compensation from the Released Parties for such incidents, and agree to indemnify and hold harmless the Released Parties from any third-party claims related thereto.
The fire pit may be used by guests following a demonstration provided by the host on safe operation. The host’s demonstration does not constitute ongoing supervision or guarantee of safe use.
Any use of the fire pit is strictly at the guests’ own risk, including but not limited to risks of burns, fires, smoke inhalation, injuries, property damage, or other accidents arising from fire building, wood handling, or related activities. Guests acknowledge that improper use can result in severe harm and that expert knowledge of fire safety is required.
Guests are obligated to use the fire pit carefully and responsibly, including but not limited to: ensuring the fire pit is placed at least 10 feet from structures, furniture, flammables, and people; never leaving the fire unattended; using only host-provided or dry, seasoned firewood (no trash, plastics, or accelerants); keeping children and pets at a safe distance; extinguishing the fire completely with water or sand before leaving the area or going to sleep; and confirming no embers or fire risks remain after use. Failure to comply constitutes a material breach of these Terms and Conditions.
To the fullest extent permitted by law, the Released Parties shall not be liable or responsible in any way for any claims, demands, actions, damages, losses, or expenses (including legal fees) arising out of or related to fire pit usage, whether due to negligence, misuse, or otherwise. By booking and agreeing to these Terms and Conditions, guests expressly assume all such risks, waive any right to sue or seek compensation from the Released Parties for such incidents, and agree to indemnify and hold harmless the Released Parties from any third-party claims related thereto.
Access to the property is via a private off-road road with steep inclines and declines typical of mountainous terrain, which may be challenging or unsuitable for certain vehicles, weather conditions, or driving experience levels. Guests are advised to assess their vehicle’s capabilities and driving skills prior to arrival and to proceed at their own discretion.
Any ascent, descent, or use of the access road is strictly at the guests’ own risk, including but not limited to risks of vehicle damage, accidents, injuries, loss of control, or other hazards arising from road conditions, weather, terrain, or improper operation. Guests acknowledge that the road is unpaved, unmaintained for public use, and subject to natural variations such as mud, rocks, or snow.
Guests are obligated to use the access road carefully and responsibly, including but not limited to: driving at appropriate speeds (not exceeding 10 mph); ensuring all passengers are secured; avoiding use during adverse weather unless experienced; and reporting any road hazards to the host immediately upon discovery. Failure to comply constitutes a material breach of these Terms and Conditions.
To the fullest extent permitted by law, the Released Parties shall not be liable or responsible in any way for any claims, demands, actions, damages, losses, or expenses (including legal fees) arising out of or related to access road usage, whether due to negligence, road conditions, or otherwise. By booking and agreeing to these Terms and Conditions, guests expressly assume all such risks, waive any right to sue or seek compensation from the Released Parties for such incidents, and agree to indemnify and hold harmless the Released Parties from any third-party claims related thereto.
I have read, understood, and agree to abide by the above Terms and Conditions for my stay at 313 Clancy Road, Braintree, VT, 05060, including all safety rules regarding the treehouse and zipline. I acknowledge that violation of these terms may result in eviction without refund. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By signing below, I confirm my agreement to these terms and accept responsibility for compliance by all members of my party.
This is to certify that I/we as parent(s)/guardian(s) with legal responsibility for this participant, do consent and agree not only to his/her release as provided above, but also for myself/ourselves, my heirs, assigns, and next of kin to release and indemnify the releasees from any and all liability incident to my/our minor child’s involvement as stated above, even if arising from the negligence of the releasees, to the fullest extent permitted by the laws of the State of Vermont.
