Terms & Conditions

1. General

• These Terms & Conditions apply to all guests and visitors.
• The property includes a treehouse, zipline, and surrounding grounds. Guests enter and use the property at their own risk.

2. Check-In & Check-Out

• Check-in: after 3:00 PM.
• Check-out: by 11:00 AM.
• Early check-in or late check-out may be available upon request but must be approved in advance.

3. Guests & Visitors

• Maximum occupancy: 5 persons.
• Only registered guests are permitted to stay overnight.
• Unregistered visitors must be approved by the host.

4. Conduct & Noise

• Quiet hours: 10:00 PM – 8:00 AM.
• Smoking is prohibited inside the treehouse. Outdoor smoking is permitted only in designated areas.
• Excessive alcohol consumption, illegal substances, and disorderly conduct are strictly prohibited.

5. Safety & Use of Facilities

• The treehouse, zipline, and surrounding areas must be used responsibly.
• Children are allowed only under direct supervision of a parent or guardian.
• Guests must follow all posted safety instructions and verbal directions provided by the host.
• Climbing on structures, trees, or equipment outside of designated areas is prohibited.

5.1. Zipline Usage

The zipline may only be used with the express permission and under the direct supervision and accompaniment of the host.

Any unauthorized use of the zipline, including without limitation self-attachment or operation without host supervision, is strictly prohibited.

The host shall not be liable for any accidents, injuries, damages, or losses arising from or related to unauthorized or unsupervised use of the zipline, and guests assume all risks associated with such.

5.2. Foraging and Consumption of Wild Mushrooms

Guests are permitted to forage for wild mushrooms on the property at their own discretion, but the host does not provide guidance, identification, or endorsement of any such activities.

Any consumption of wild mushrooms foraged by guests is strictly at the guests’ own risk, including but not limited to risks of misidentification, poisoning, allergic reactions, illness, or death. Guests acknowledge that wild mushrooms can be highly toxic and that expert mycological knowledge is required for safe identification and consumption.

To the fullest extent permitted by law, the Released Parties shall not be liable or responsible in any way for any claims, demands, actions, damages, losses, or expenses (including legal fees) arising out of or related to foraging or consumption of wild mushrooms, whether due to negligence, misidentification, or otherwise. By booking and agreeing to these Terms and Conditions, guests expressly assume all such risks, waive any right to sue or seek compensation from the Released Parties for such incidents, and agree to indemnify and hold harmless the Released Parties from any third-party claims related thereto.

5.3. Grill Usage

The grill, which operates on both propane and charcoal, may be used by guests following a demonstration provided by the host on safe operation. The host’s demonstration does not constitute ongoing supervision or guarantee of safe use.

Any use of the grill is strictly at the guests’ own risk, including but not limited to risks of burns, fires, explosions, injuries, property damage, or other accidents arising from cooking, propane handling, charcoal preparation, or related activities. Guests acknowledge that improper use can result in severe harm and that expert knowledge of grill safety is required.

Guests are obligated to use the grill carefully and responsibly, including but not limited to: ensuring the grill is placed at a safe distance from structures, flammables, and people (at least 10 feet from any building); closing all propane valves and connections tightly after each use; extinguishing coals completely and disposing of ashes safely; monitoring the grill at all times while in use; and confirming no fire risks before, during, and after operation. Failure to comply constitutes a material breach of these Terms and Conditions.

To the fullest extent permitted by law, the Released Parties shall not be liable or responsible in any way for any claims, demands, actions, damages, losses, or expenses (including legal fees) arising out of or related to grill usage, whether due to negligence, misuse, or otherwise. By booking and agreeing to these Terms and Conditions, guests expressly assume all such risks, waive any right to sue or seek compensation from the Released Parties for such incidents, and agree to indemnify and hold harmless the Released Parties from any third-party claims related thereto.

5.4. Fire Pit Usage

The fire pit may be used by guests following a demonstration provided by the host on safe operation. The host’s demonstration does not constitute ongoing supervision or guarantee of safe use.

Any use of the fire pit is strictly at the guests’ own risk, including but not limited to risks of burns, fires, smoke inhalation, injuries, property damage, or other accidents arising from fire building, wood handling, or related activities. Guests acknowledge that improper use can result in severe harm and that expert knowledge of fire safety is required.

Guests are obligated to use the fire pit carefully and responsibly, including but not limited to: ensuring the fire pit is placed at least 10 feet from structures, furniture, flammables, and people; never leaving the fire unattended; using only host-provided or dry, seasoned firewood (no trash, plastics, or accelerants); keeping children and pets at a safe distance; extinguishing the fire completely with water or sand before leaving the area or going to sleep; and confirming no embers or fire risks remain after use. Failure to comply constitutes a material breach of these Terms and Conditions.

To the fullest extent permitted by law, the Released Parties shall not be liable or responsible in any way for any claims, demands, actions, damages, losses, or expenses (including legal fees) arising out of or related to fire pit usage, whether due to negligence, misuse, or otherwise. By booking and agreeing to these Terms and Conditions, guests expressly assume all such risks, waive any right to sue or seek compensation from the Released Parties for such incidents, and agree to indemnify and hold harmless the Released Parties from any third-party claims related thereto.

5.5. Access Road Usage

Access to the property is via a private off-road road with steep inclines and declines typical of mountainous terrain, which may be challenging or unsuitable for certain vehicles, weather conditions, or driving experience levels. Guests are advised to assess their vehicle’s capabilities and driving skills prior to arrival and to proceed at their own discretion.

Any ascent, descent, or use of the access road is strictly at the guests’ own risk, including but not limited to risks of vehicle damage, accidents, injuries, loss of control, or other hazards arising from road conditions, weather, terrain, or improper operation. Guests acknowledge that the road is unpaved, unmaintained for public use, and subject to natural variations such as mud, rocks, or snow.

Guests are obligated to use the access road carefully and responsibly, including but not limited to: driving at appropriate speeds (not exceeding 10 mph); ensuring all passengers are secured; avoiding use during adverse weather unless experienced; and reporting any road hazards to the host immediately upon discovery. Failure to comply constitutes a material breach of these Terms and Conditions.

To the fullest extent permitted by law, the Released Parties shall not be liable or responsible in any way for any claims, demands, actions, damages, losses, or expenses (including legal fees) arising out of or related to access road usage, whether due to negligence, road conditions, or otherwise. By booking and agreeing to these Terms and Conditions, guests expressly assume all such risks, waive any right to sue or seek compensation from the Released Parties for such incidents, and agree to indemnify and hold harmless the Released Parties from any third-party claims related thereto.

6. Wood Stove

• A wood-burning stove is provided for heating.
• Guests may only use the stove if they are familiar with safe operation.
• Only firewood provided by the host may be used.
• It is strictly prohibited to burn trash, plastics, or other non-wood materials.
• The stove door must remain closed while in use.
• Guests are fully responsible for monitoring the fire and ensuring it is safely extinguished before leaving the treehouse or going to sleep.
• The host is not liable for injuries, burns, smoke inhalation, or property damage resulting from improper stove use.

7. Food & Beverages

• Meals such as dinner and breakfast may be offered on a donation-only basis.
• Food is not prepared in a licensed facility and is not part of any restaurant or catering service.
• Guests assume full responsibility for any allergies, dietary restrictions, or adverse reactions.

8. Liability & Assumption of Risk

• Guests acknowledge that outdoor activities involve inherent risks including, but not limited to, falls, injuries, allergic reactions, encounters with insects, and weather conditions.
• The host is not liable for accidents, injuries, illnesses, theft, loss, or damage to personal belongings during the stay.
• Guests agree to sign a separate Waiver & Release of Liability prior to participation in activities such as the zipline.

9. Cleanliness & Damages

• Guests are expected to leave the property in a reasonably clean condition.
• Any damage to the property, furnishings, equipment, or grounds caused by guests must be reported immediately and may be charged to the guest.

10. Pets

• Pets are not allowed.

11. Cancellations & Refunds

• All cancellations and refunds are subject to the booking platform’s policy, unless otherwise agreed directly with the host.

12. Governing Law

• These Terms & Conditions shall be governed by and construed under the laws of the State of Vermont.
• Any disputes arising from the stay shall be resolved exclusively in Vermont courts.

13. Breach of Terms

• Failure to comply with these Terms & Conditions may result in immediate termination of stay without refund.

14. Absolute Right to Refuse Service

• The host reserves the absolute and unrestricted right to refuse service, deny entry, or terminate any guest’s stay at any time, for any reason or no reason, without explanation.
• In the event of refusal or termination, no refund of any kind will be issued.
• Guests agree, by booking, to vacate the property immediately upon request of the host.
